• New York State Education Law Section 100.2(ee) requires school districts to provide Academic Intervention Services to students who score below the State designated performance level on State assessments and/or who are at risk of not achieving the State learning standards. School districts are required to provide these services to students and to monitor their progress toward improvements.

    Districts identify students through a two-step process:

    • First, all students performing at or below a median score between Level 2 (Partially Proficient) and Level 3 (Proficient) are identified for consideration for Academic Intervention Services. All students performing at or below this median cut score will be considered for Academic Intervention Services. The cut score is established by the New York State Education Department. 
    • Upon identification of a student for consideration for Academic Intervention Services, districts then use a locally developed procedure to be applied uniformly at each grade level. This procedure considers the student’s performance on multiple measures of student performance, which may include, but are not limited to, the following:
      • Developmental Reading assessments for grades kindergarten through six
      • New York State English as a Second Language Achievement Test (NYSESLAT)
      • Benchmark and lesson-embedded assessments for Reading and Math in grades kindergarten through six based on teacher designed and selected assessments
      • Common formative assessments (CFAs) that provide information about students’ skills
      • Unit and lesson assessments for English Language Arts, Math, Science, Social Studies and Languages Other than English (LOTE) for grades seven to twelve
      • Results of psychoeducational evaluations based on a variety of assessments and inventories

    Districts have the flexibility to determine that a student who scores above the cut scores for eligibility may also receive Academic Intervention Services. This determination may be made on the recommendation of a teacher and/or on the results of multiple measures of assessment.

    The Lancaster Central School District recognizes and adheres to these regulations when determining the provision of Academic Intervention Services.
